This Terms of Service (“Agreement”) is between Xi Xiantian (the “Developer”) and you (“User”) of the Chinese Pinyin application (the “App”), distributed on the Apple App Store and Google Play. By installing, accessing, or using the App, you agree to be bound by this Agreement.
1. Services
The App provides Mandarin learning features, including but not limited to: daily conversations, phrases, vocabulary, translation of user inputs into Chinese, auto-translation of support replies when enabled, and in-app purchase/subscription benefits and management.
2. Acceptable Use
You agree not to: post or distribute illegal/infringing/inappropriate content; reverse engineer, decompile, break, or bypass security measures; copy, modify, rent, sell, or sublicense the App without authorization; interfere with normal operation; or engage in any unlawful activity using the App.
3. Purchases and Subscriptions
The App requires no registration or sign-in; it may generate an anonymous identifier to keep your learning progress and purchase entitlements in sync across sessions. Purchases and subscriptions are processed and billed by the app store through which you obtained the App — the Apple App Store or Google Play. Pricing, billing periods, free trials, and renewal terms are as displayed in that store at the time of purchase. Unless cancelled at least 24 hours before the current period ends, subscriptions renew automatically; you can manage or cancel them at any time in your store account’s subscription settings (App Store or Google Play). Refunds are handled by the respective store under its own policies; the Developer does not directly process payment refunds.
For purchases made through the Apple App Store, Apple’s standard Licensed Application End User License Agreement also applies to the extent it does not conflict with this Agreement. For purchases made through Google Play, the Google Play Terms of Service also apply.
You may stop using the App at any time and may request deletion of your data as described in our Privacy Policy.
4. Intellectual Property
All content and resources in the App (text, audio, images, video, code, data, etc.) are owned by the Developer or its licensors. Unauthorized copying, distribution, or use is prohibited.
5. Third-Party Services
The App may integrate third-party services (e.g., translation APIs, crash analytics/diagnostics, in-app purchases and receipt verification). Use of those services is subject to their respective terms and privacy policies.
6. Disclaimer
The App is provided “as is” without warranties of any kind, express or implied. The Developer is not liable for interruptions, data loss, or limitations caused by networks, devices, third-party services, or force majeure. Learning content is for reference only and may vary by context.
7. Limitation of Liability
To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, punitive, or consequential damages. For direct damages, the total liability shall not exceed the amount you paid for subscriptions in the twelve (12) months prior to the claim that was not refunded by the applicable app store, if any.
8. Termination
If you materially breach this Agreement or applicable law, the Developer may suspend or terminate your access to the App without prior notice and reserves the right to pursue legal remedies.
9. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the Developer’s domicile. Disputes shall first be resolved amicably; failing that, they shall be submitted to the competent court where the Developer is domiciled.
10. Changes
The Developer may update this Agreement for service improvements or legal/regulatory changes. Material changes will be communicated via in-app notice or other reasonable means. Updates take effect upon posting unless stated otherwise. If you do not agree, please stop using the App.
